i tried that out, and i realized if you kill him you can't join, but then i reloaded it, i got that thing after i killed the 3 argonian prisoners

You can't kill him because he's part of multiple quests.... I've tried to kill him many times when he tries to fire you after you kill the old listener in the one quest.
